Terms of use / ΟΡΟΙ ΧΡΗΣΗΣ

1. Introduction

1.1 Creative Options, hereinafter, referred to as “Company”, is a services provider created by the Company “SMD Single P.C.”, based in Kerkyra at Donatos Dimoulitsa 34, with VAT No: 800581500, Tax Office:DOY A’ of Corfu, Tel.: 00302661022726 & 00302661028600. The following terms and conditions apply to the use of the website of the Company, which is available at www.creativeoptions.eu and the services provided by the Company. By using the website or services provided by the Company, users indicate full acceptance of the terms and conditions set out or put forward by the Company in the future.

1.2 If a user or representative of a user does not agree with these terms and conditions, he/she must not make use of the site or services of the Company. Users of the Company or visitors of the site https://www.creativeoptions.eu/ will be referred to as “Client”, whether he/she makes orders or utilize services of the Company.

2. Copyrights

2.1 This website is one of the official online stores of the Company. All site content, including images, graphics, photographs, drawings, text, services and products are the intellectual property of the Company and are protected by the relevant provisions of Greek law, European law and international conventions. All site’s content is deposited at a notary who is the certified holder of all intellectual property.

2.2 Any copying, distribution, transportation, processing, sale, derivative creation or misleading the public about the actual content of the provider website is against the laws and any reproduction, republication, loading, communication, distribution or transmission or any other use of the Content in any manner or medium for commercial or other purposes is allowed only after prior written authorization of the Company or any other copyright holder. The names, images, logos, and distinctive features representing the Company or third parties and their products or services belong to the Company or third parties and are protected by the relevant trademark laws. Their appearance on the website should in no way be construed as a transfer or license or right to use them.

3. Responsibility and Services of the Company

3.1 The Client confirms that the material, which is uploaded to the server, is ready and will not require any additional processing by the Company to operate. The Company has full access to files, websites and Customer data.

3.2 The Customer is notified via email by the Company about how they can gain access to the Control Panel and also about how to publish files on the Internet, the establishment of email accounts and the manual usage of the virtual server and the Control Panel.

3.3 The Client agrees that he has the necessary knowledge for the construction / publishing of web pages and that the Company is not responsible to provide such knowledge or other programming knowledge to the Customer or to educate him. The Company is not obliged to provide technical support except as specified herein. The Company may make an exception, if it so wishes, to provide support and suggestions on matters not related to the hosting site (Additional Support).

3.4 Any request for additional technical support may be refused by the Company with or without reason. It is the sole option of the Company whether to provide any additional technical support or not. If the Company decides to provide additional support, the Company can interrupt it at any time without notice and without any obligation or responsibility.

3.5 The Company does not exercise control over the content of the information, which passes through its network of servers, and it also does not guarantee the credibility of any information, which appears on the Internet through or because of its services. Moreover, it does not guarantee the solvency of any commercial or personal website presented in any meeting. It also does not guarantee any specific promises/offers from third parties and is not responsible for any damage which may occur to the client or those who deal with him/her, including loss of data, delays by any cause, non-stop delivery of goods or services by any cause, mistakes or omission.

3.6 The use of any information provided through the Internet is the responsibility of the user and the Company has no responsibility for the accuracy or quality of any such information. The connection speed indicated on the website represents the speed of the core network (backbone) and not the speed from end to end.

3.7 The Company has no responsibility for any damage caused in case of non-availability of network or system and does not guarantee that the hosting service will be uninterrupted or that there will not be any mistake, given the special nature of the Internet and the networks through which the information is distributed.

3.8 The Company, under any conditions and circumstances and by any cause, has no liability for any damage resulting from the use, availability or non-availability of services offered.

3.9 The Company periodically upgrades the installed applications on the existing servers in order to maintain security levels at the highest possible level and to provide the latest versions of Plesk Control Panel, PHP, MySQL, ASP.net, Perl, Zend, Ioncube, etc. It is the sole responsibility of the Client to check that code (codes like PHP, MySQL queries, ASP etc. in which the client maintains his websites on the site offered by the Company) to be compatible with the Company servers. The Company is not responsible for any loss, damage or moral damage resulting from these upgrades caused by the inability or unwillingness of the Client to customize the website with upgraded versions of various applications and Programming Languages that are installed on the servers Company or by any other means.

3.10 The Company shall bear no responsibility or liability for any loss, damage or moral damage resulting from failure in service or technical support and the Customer accepts that this will not be a factor to raise any claims.

3.11 The Company periodically takes backups of files and databases of Clients who use hosting services of the servers. The recovery of files from the backup is charged. The Company does not assume any responsibility if the backup is not updated or is not used. The Customer is required to keep backup files and databases using Creative Options’s Backup/Restore tool that is found in the Control Panel. For security reasons, the backup will be transferred by FTP to the Client’s computer.

3.12 The Company will deliver the service within some minutes, after the client’s payment. In some cases, given the nature of such services, the service delivery might take up to some hours or days.

3.13 The Company will cooperate with the authorities responsible for law enforcement and will provide information relating to space, data, email and content of the Customer. This may lead to disclosure of all information given to the Company including information located on servers of Company, which also includes the files, and databases of Client.

3.14 The Company shall not be liable to the Client/user for any damages resulting from the performance or failure of their order or for the type of service. This is also reserved for the time of delivery of products/services in cases of force majeure.

3.15 The Company creates partnerships or alliances with other companies and suppliers. The Client acknowledges and agrees that the Company is in no way responsible for the products or services of any third party and will not be responsible or liable to the Customer or any third party for any claims arising from the use of such products or services.

3.16 All web hosting accounts display a “Under Construction” web page by default when activated. This page informs visitors that the user has recently setup their account with the Company. The “Under Construction” default index web page may be removed by the Member at any time once they have access to the web server. The “Under Construction” web page may include such things as, without limitation

(i) links to additional products and services offered by the Company

(ii) advertisements for products and services offered by third-parties, and

(iii) an internet search engine interface. Free hosting transfer to Creative Options Policy

3.17 Service Level Agreement (SLA)
This agreement describes the warranty for the availability of the network of Creative Options’s services. The warranty applies to any of Creative Options’s customers that do not have any pending payment obligation at Creative Options.

Format and procedure of applying the warranty.
Creative Options’s main goal is to ensure that the content of the hosted websites is available (uptime) for access from anywhere in the world, at anytime. The service downtime is defined as the loss of all from Creative Options to the providers of the backbone network.

Creative Options’s goal is to keep the average time the Webserver or the Database Server are unavailable to 0.1% or less during a calendar month as measured by Creative Options.

If the Webserver or the Database server of the shared hosting plan that your site is hosted is available less than 99.9% of a calendar month, Creative Options will add one more month of hosting to your hosting plan for free.

The period of time that the service is unavailable is counted from the moment that the customer informs about it, during the interruption, by sending a ticket to Creative Options from the page http://support.CreativeOptions.eu or by calling Creative Options’s Support Team. Creative Options’s administrators will determine when the interruption ended.

The month added corresponds with the monthly fee of the main service plan paid by the customer, with the monthly data transfer limit, excluding additional services, such as additional IP addresses, support services etc.

Restrictions

The customer will not receive any warranty for any failure, malfunction or unavailability of the website that is caused or related to:

a. circumstances beyond the reasonable control of Creative Options including, without limitation, governmental activities, war, revolution, sabotage, armed conflict, blockade, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, inaccessibility or interruption or delay in telecommunications or third party services, virus or hacker attacks, failure of third party software (including, without limitation of the e-commerce software, payment gateways, chat, statistics or free scripts) or inability to obtain raw materials and supplies or to take the action required for the use of appropriate equipment for the provision of this SLA.

b. Planned or urgent maintenance or enhancement works on the technical equipment.

c. Issues of the DNS, FTP, POP, IMAP ή SMTP client access

d. False reports about the function of Creative Options’s systems. e. The Clients actions or omissions, including, without limitation, the code (e.g. CGI, Perl, HTML, ASP, etc), any negligence, willful misconduct or misuse of services with violation of Creative Options’s terms and conditions and the articles of acceptable Use Policy.

f. e-mail or webmail delivery or transmission

g. outages elsewhere on the Internet that hinder access to the Customer. Creative Options is not responsible for the web browsers or the DNS that can make the service anaccesible to the Customer. Creative Options, is also not responsible for problems that arise due to the quality of internet access by the provider selected by the Customer. Creative Options will guarantee only those areas under its own control, meaning the servers, server routers and their connection to the Internet.

3.18 Free Hosting Transfer Policy for plans transferred to Creative Options

For each new Shared or Managed WordPress Hosting at Creative Options, there is no limit to the number of static or dynamic web pages that the customer can request to be transferred for free (as long as this number is supported by the specific plan). The necessary conditions for overtaking the process for free are:

a) to fill in the transfer form found here: https://www.creativeoptions.eu/host within 90 days from the day of the payment for a new plan.
b) when the form is sent, the files to be transferred should be hosted to another provider and not Creative Options.
c) access to administration environment of the server hosted to the other provider or backup of the files and databases to be transferred.

If a transfer form is sent to Creative Options’s Support Department, in any other case, the transfer costs 25€ + VAT per site. Creative Options’s Support Department provides transfer instructions for free via email after request, so that the Customer can make the transfer on his own, if the Customer wishes to.

4. Domain Name management and registration regulations for domain names

4.1 The Customer/Client and/or the future owner of domain names must fully read and understand the domain name management and registration regulations for domain names and all of its modifications that might occur.

4.2 Creative Options takes no responsibility if, during before or after the customer’s payment for an order, the domain chosen by the customer has been registered by someone else, as Creative Options registers domains after the payment has been confirmed by the accounting department. If this is the case, then the Customer may register another domain(s).

The registration of domain names besides the .GR tld, is not complete until the customer’s payment is confirmed by our accounting apartment. Confirmations by the accounting department take place in 1 – 2 working days from the day of the payment. If the customer wishes to register live, and have the domains activated immediately, he/she must select a different payment method (credit card, paypal or credits at Creative Options).

4.3 .COM, .NET, .ORG, .INFO etc. domain names (except .GR and .EU) that have been renewed in less than 45 days with your present registrar, will not be renewed for one additonal year if tranfered to Creative Options, as it normally happens.

4.4 The Client (Registered Name Holder) shall provide to Registrar accurate and reliable contact details and promptly correct and update them during the term of the Registered Name registration, including: the full name, postal address, e-mail address, voice telephone number, and fax number if available of the Registered Name Holder, the technical contact and the administrative contact; name of authorized person for contact purposes in the case of an Registered Name Holder that is an organization, association, or corporation; the primary nameserver and secondary nameserver(s) for the Registered Name. The registrar may request to validate the Registered Name Holder’s WHOIS information at any time e.g. in case of an abuse report, and has the right to place the domain in Registrar Hold Status until the domain owner (RNH) provides updated and accurate whois information.

4.5 The Client shall indemnify and hold harmless the Company (Registry Operator) and its directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and expenses) arising out of or related to the Registered Name Holder’s domain name registration.

4.6 A Client’s willful provision of inaccurate or unreliable information, its willful failure promptly to update information provided to Registrar, or its failure to respond for over fifteen (15) calendar days to inquiries by Registrar concerning the accuracy of contact details associated with the Client’s domain registration shall constitute a material breach of the Client-registrar contract and be a basis for cancellation of the Registered Name registration.

4.7 Any Client that intends to license use of a domain name to a third party is nonetheless the Client of record and is responsible for providing its own full contact information and for providing and updating accurate technical and administrative contact information adequate to facilitate timely resolution of any problems that arise in connection with the Registered Name. A Client licensing use of a Registered Name according to this provision shall accept liability for harm caused by wrongful use of the Registered Name, unless it promptly discloses the current contact information provided by the licensee and the identity of the licensee to a party providing the Client reasonable evidence of actionable harm.

4.8 Use of Information / Consents. The Client acknowledges and consents to use of Domain Registrant’s information for the following purposes: (i) transmission to the applicable Registrar, Registry Operator, Registry and others who will receive the information from the Registry Operator or Registrar; (ii) free public query-based access of Registrant Data concerning the active domain registrations; (iii) use by the Registrar for inclusion in registers and database(s) produced by the Registrar or its licensees.

The Client may access the Data provided to the Registrar by accessing their client account on the registrar websites.

The Client warrants that it has provided notice to, and has obtained consent from, any third party individuals whose data is supplied to the Registrar regarding the uses of such information as set forth in clauses (i), (ii) and (iii) of this Section.

The Registrar agrees that it will not process the data collected from the Client in a way that is incompatible with the purposes and limitations set out in this Section. The Registrar further agrees that it will take reasonable precautions to protect data obtained from Client from loss, misuse, unauthorized access or disclosure, alteration or destruction.

4.9 The Client shall represent that notice has been provided and obtained consent equivalent to that described in Subsection 4.8 to any third-party individuals whose Personal Data are supplied to Registrar by the Client.

4.10 The Client shall represent that, to the best of the Client’s knowledge and belief, neither the registration of the Registered Name nor the manner in which it is directly or indirectly used infringes the legal rights of any third party.

4.11 For the adjudication of disputes concerning or arising from use of the Registered Name, the Client shall submit, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (1) of the Client’s domicile and (2) where Registrar is located.

4.12 The Client shall agree that its registration of the Registered Name shall be subject to suspension, cancellation, or transfer pursuant to any ICANN adopted specification or policy, or pursuant to any registrar or registry procedure not inconsistent with an ICANN adopted specification or policy, (1) to correct mistakes by Registrar or the Registry Operator in registering the name or (2) for the resolution of disputes concerning the Registered Name.

4.13 Specific renewal limitations:

.AT domains must be renewed at least 35 days before their expiration date.

.FR domains must be renewed at least 9 days before their expiration date.

.LI domains must be renewed at least 62 days before their expiration date.

.CH domains must be renewed at least 62 days before their expiration date.

.CO domains must be renewed at least 12 days before their expiration date.

4.14 The client explicitly consent to the deletion of the .de domain upon it’s expiration date.

4.16 The Code of Practice of Creative Options is published on our Web site at https://www.creativeoptions.eu/en/cop.htm

5. User Responsibility and Non-Permissible Use of Servers or/and Domains

5.1 The Client accepts that he/she will not use the website of the Company, its services and servers for:

i. Posting, publication, sending an email transmission or any other means of any content which is illegal, harmful, threatening, offensive, disturbing, slanderous, defamatory, vulgar, obscene, a violation of the privacy of another, shows hatred or is racial, ethnic or of any other discrimination.

ii. Doing anything, which causes damage to minors in any way.

iii. Posting, publication, sending an email transmission or any other means of using any content for which you have no right to broadcast in accordance with the law or administrative or contractual relationships (such as inside information, proprietary and confidential information obtained or disclosed as part of industrial relations or covered in confidentiality agreements).

iv. Posting, publication, sending an email transmission or any other means of using any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of others.

v. Posting, publication, sending an email transmission or any other means of usage of any material that contains software viruses or any other codes, files or programs designed to break, damage, or destroy the equipment operation of any software or hardware.

vi. Intentional or unintentional violation of applicable laws and provisions.

Vii. Harassment of anybody in anyway.

Viii. Illegal collection or storing of personal data relating to other users.

5.2 The Company has the ability to reject or delete material flowing into the server granted that this material infringes any law relating to copyright, or is pornographic, racist or pirated content (hacking, pirate software, warez sites, serial numbers etc.), in respect of drug trafficking, illegal attempt to enter a computer or contrary to any law. In such cases the Company has the right to immediately disable the account without any prior notice and block the access to the site via the Internet without any liability for any damage caused to the Customer or to the third parties. Then, the Client is informed to remove the material. If the Client does not comply immediately, the Company has the right to delete the account entirely.

5.3 The Company follows a very strict policy on spam emails, and may cancel the Client account if in the case of unorthodox delivery / bulk unwanted email (spam mail). An email is spam when sent to multiple recipients who have not requested to receive. The Client agrees not to send any of the following types of email: (a) advertising or information, including but not limited to commercial advertising, except to those who have explicitly requested such emails from the Client. (b) annoying email, through written language, or the frequency or size of messages (c) chain mails (d) bulk advertising, information or Email.

Creative Options reserves the right to decide whether an action of a client is considered “spam”, “mail bombing”, or “bulk email”. Customers who use the services of the Company for spamming will be billed an amount for costs of management and system recovery. Solely the Company determines this amount.

5.4 Creative Options retains the right, at our sole discretion, to restrict the volume of messages transmitted or received by you in order to maintain the quality of our email services to other Members and to protect our computer systems.

As owner and/or operator of the equipment and other resources utilized to provide services, Creative Options has the legal right to block electronic communications from other entities on the Internet.

5.5 The available resources of the server are reserved for use within the accounts of Clients of the Company only. An allocation of resources in any manner to any third party sites including but not limited to graphic or text extraction sites from the material at the Company server, running banner exchange programs, etc. is strictly prohibited.

5.6 SSH access is given at the request of the Clients. For security reasons, the Customer will have to justify why he wants to access SSH. The Company has the right to refuse access or provide limited access to run commands.

5.7 The dispatch of annoying electronic messages on the server and/or any disturbing message sent to any user on a network directly or indirectly connected with the Company and an attempt to bypass the user authentication or security of host, network or account is prohibited. An intrusion into information that is not addressed to the Customer is prohibited. An infringement of security of any network, Spawning, Port scans, ping floods, packet spoofing, forging router information, denial of service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop, the publication of viruses, performance chat rooms, Internet Relay Chat, IRC bots (like eggdrop), PhpShell and other similar programs, audio, radio and video streaming, and upload files to the server for the purpose of downloading by the general public (or using a domain for this purpose) is prohibited. Any activity, if it leads to loss of information, will be investigated and appropriate action will be taken (e.g. suspend site or/and domain until prohibited activity is terminated).

5.8 Unauthorized background processes or licensed background processes that endanger the security of our servers will result in the cessation or termination of the Customer’s account.

5.9 The Client agrees that he/she will construct the website in such a way that the overloading of Creative Options Servers is avoided and the usage of code/applications that require high processing power is limited. Creative Options has the right, if the Client site is the cause of problems in hosting services of other Client on the same server, to disable the service/access to the site immediately and without prior notice to the Client. If Creative Options takes such an action, the Client will be informed as soon as possible and Creative Options will work with the Client to eliminate the reason that led to the suspension of services.

5.10 The Client agrees to the following conditions:

i. Do not use 25% or more of the server for longer than 90 seconds. This includes any other effects that can cause the server load including CGI Scripts, PHP Scripts, FTP, HTTP, SMTP load, etc. This condition is not valid for dedicated servers.

ii Do not perform any autonomous process in the server. This includes demons and any executable files of similar nature such as IRCD, chat demons, .exe, .com, etc.

iii. Do not perform any type of web Spider Indexer (including Google Cash / AdSpy).

iv. Do not perform any bit torrent application, track or client. Hosting or linking any illegal migrant records is prohibited.

v. Do not contribute to any activity associated with file-sharing & peer-to-peer networks.

vi. Do not perform any gaming servers such as counter-strike, half-life, battlefield1942, etc. This condition is not valid for dedicated servers.

vii. Do not run cron tasks and schedule tasks for intervals of less than 15 minutes. This condition is not valid for dedicated servers.

Viii. Do not use any script to invite any file, which is local. The calling of any file or URL to a remote server should be reported to the Company when dealing hosting or shared hosting. The Company has the right to prohibit this without prior notice to the Client.

ix. Do not have the server Mailbox size exceeding 100 Mb. This condition is not valid for dedicated servers.

5.11 The Customer must use the website solely as a conventional website. The use of services and equipment of the Company must always be in a manner, which is consistent with this Agreement and in no case should affect the operation of equipment or network of the Company. The excessive use of system resources is not acceptable. If the use of services of the Company by the Client creates problem for the Company or is beyond the permitted limits or is the cause of overloading the equipment and resources of the Company, the Company may suspend the operation of the account and will be resolved only after determining the cause of overloading. The Company reserves the right the elimination of intensive mechanisms, which may affect the CPU. This condition is not valid for dedicated servers.

5.12 Shared accounts may not resell web hosting to other people; if you wish to resell hosting you must use a reseller account.

5.13 The Customer understands and agrees that no part of the services offered by Creative Options, such as space, email or data transfer (bandwidth) can be used for backup purposes (backups). The client may in no case upload, download or save in the space provided for files that are not directly related to what is necessary for the operation of the website, with the exception of maintaining a backup of the Client’s site. This term does not apply to Dedicated Servers.

5.14 The Client must monitor the size of the space the website occupies on the hard disks of the Company so as not to exceed the limits set. If the space occupied exceeded, the Company will charge the Client for the use of additional resources and reserves the right to delete files to get the used space into the permissible limits. This term does not apply to Dedicated Servers.

5.15 It is the responsibility of the Client to ensure that the code and applications that are installed on the account are safe and the rights of the directories and files are correct, regardless of how it was installed. Where it is possible, the client must add to catalogs and archives, 755 rights, or as much as restrictive as possible. The Client is responsible for all acts performed on his/her behalf.

5.16 The Client must use a secure password. If the password used by the Client is simple, the account may be suspended until you use a secure password.

5.17 Website Builder Service: It is not recommended having more than 30 widgets on a page because this will probably make the page very slow to load. The company does not offer support for any page with more than 60 widgets.

6. Free Hosting Terms of Use

6.1 Basic Hosting is provided to a client who has purchased domain registration or renewal services at least once from Creative Options, or has changed from another registrar to Creative Options and is not using other paid hosting plans for the related domain.

6.2 The Basic Hosting plan is privided for free on a year basis. The renewal of the Free basic plan can be made one month before the plan’s expiration, if the domain is still active, in the same account and with the provided Nameservers.

6.3 All free web hosting plans are connected to a specific domain name at Creative Options. Members using the free Basic Hosting service, but no longer qualify due to no active domain name registration with Creative Options, are subject to mandatory Hosting Upgrade to a paying package within a week. User accounts may be deleted after 1 week.

6.4 FTP usage for webcam purposes is not to exceed uploading once every 30 seconds.

6.5 Creative Options, for releasing unused resources, has the right to to delete any account, unactive for more than 30 days in a row, or with less than 2 unique visitors per day.

6.6 To activate the Free Hosting plan for a domain, all free eShop or free Website services must be deactivated, in case they had been activated in the past, for the same domain.

6.7 Technical support for the free Hosting is offered only via email/ticket.

7. Additional Terms of Use for ecommerce services (Creative Optionsshop.gr)

7.1 The website «http://www.CreativeOptions.eu» (from now and on «Creative Options shop») has been created for third-party individuals, companies or other legal entities, as well as for users-members (from now and on user-memebers) that wish to build, manage and launch an ecommerce site.

7.2 Creative Options does not manage the user-members ecommerce websites of Creative Optionsshop, in terms of products specifications, data or information shown. Online product orders and contracts or services offered by the eshops, are subject to the specific Terms and Conditions of each eshop, established and applied strictly between the Creative Optionsshop user-members and their customers.

7.3 1st day of operation and eshop launch of a Creative Optionsshop ecommere site, is the following day from the plan’s activation day. In case the payment method chosen is bank deposit, the services are activated after the user completes registration and confirms payment.

“Personal data and information” are defined as information provided during the users subscription at Creative Optionsshop, or/and information provided by customers, during product or services orders from Creative Optionsshop ecommerce sites. The responsibility for the accuracy of personal data and information encumbers solely the provider of them, since Creative Optionsshop acts as a mean of online presence and publisher of such information, passively.

7.4 User-members that create and operate ecommerce websites through Creative Optionsshop, are obliged, on their own initiative and diligence, to establish their own terms and conditions, governing the operation of their ecommerce site.

7.5 The Company has the option to reject, delete material or cancel any account supplied to its server, if this material
infringes any law in relation to copyright, if it is a copy product or containes pornographic, racist or pirated content (hacking, pirate softwares, warez sites, serial numbers), relates to drug trafficking, illegal intrusion attempt on a computer or contrary to any other law. In such cases, the Company has the right, without prior notice, to immediately disable the account and access to the site via the Internet without any liability for any damages caused to the Customer or any third party. Then the company will inform the customer to remove the material. If the customer does not comply immediately, the company has the right to delete the account entirely.

7.6 Active eshops must be registered to the Consumer Affairs registry for distance selling. 7.7 The company that owns the eshop must have a greek VAT Number. In the eshop’s administration panel, you have to fill in the greek VAT Number.

8. Additional Terms for the “Experts” service
8.1 The proposed experts are customers of Creative Options and have no other financial relationship with the company. They are not promoted for financial or other consideration, and they don’t work for Creative Options.

8.2 Creative Options has no commitment to the proposed experts or clients who choose to work with someone of the Experts. It doesn’t intervene in the communication process between two parties and in no case it gains from the conclusion of any cooperation between them.

8.3 The appearence of experts in the corresponding list, is by default in random order, per session, for all activities. Each visitor of Creative Options is able to group the displays by 2 different filters. Originally, there is a filter by activity, where for each option, the display order is by default random, per session. While in second level, there is a classification according to the area (alphabetical A-Z and Z-A), or under the company name (alphabetically A-Z and Z-A).

8.4 The breakdown by region is based on the city stated by the Expert, in the registration form.

8.5 To be enabled a customer to get registered as a Creative Options expert, would have to own at least the Superstar Badge.

8.6 To be enabled a customer to get registered as a Creative Options expert, would have to chose, during the fill out of the registration form, at least one of the listed activities. Additionally, is able to mention any extra activity.

8.7 Fields marked with an asterisk are required for the registration in the list of experts.

8.8 If a customer (when filling out the registration form of expert) introduces a competitive to Creative Options activity, this will be automatically deleted during the checking process of forms.

8.9 At the evaluation process of experts, Creative Options reserves the right not to accept an Expert’s application, without the obligation to give reasons.

8.10 Creative Options reserves the right to delete an expert from the list, in case of receiving a complaint or for other important reasons.

9. Expiration and deletion of domain names & other services

9.1 Expiration notifications The customer receives automated emails to the administrator email address notifying for the upcoming expiry of services, 65, 30, 7, 5 and 2 days before the expiration date, on the day of expiration and 3 days after the expiration date. The customer can also activate the expiration notification via sms. The customer chooses how many days before the expiration he will receive the sms. By default it is set to 10 days.
The customer can modify through Creative Options’s control panel, how many days before the expiration of a domain name he will receive a notification. The notifications sent 30 and 5 days before expiration and 3 days after expiration cannot be changed as defined by ICANN policies.
9.2 If the domain is required to be renewed certain days before its expiration date, the notification emails are adjusted and sent accordingly.

In the expiration notification emails, the customer is able to renew a domain either by logging in to the control panel, or directly wihtout logging in (1 click renewal) by clicking on the related button inside the email.

9.3 Domain expiration When a domain name expires, in most cases it enters a “quarantine” period which last approximately for 29 days (for COM, NET, ORG, INFO κοκ.), 40 days (.EU), 15 days (.GR) or 0 days (new tlds). The customer is obliged to and may receive information about the duration of “quarantine” of each domain by contacting the Support department of the Company. See 13.5 for domain renewal from “quarantine”.

9.4 Domain redemption After the 29 days of “quarantine”, or directly after the expiration of a domain when quarantine is not applicable, the domain is deleted and enters into “redemption” period, with a duration of 40 days approximately. In some cases there is no redemption period and the domain is released (e.g. .GR domains), thus the customer is obliged and may receive information about the duration of a domain’s “redemption” period by contacting the Support department of the Company. See 13.5 for domain renewal from “redemption”.

9.5 Domain deletion (Restored Names Accuracy Policy) A domain name may be deleted for other reasons than expiration, e.g. on the basis of submission of false contact data or non-response to registrar inquiries to validate WHOIS information within the timeframe of 10 days. When the registrar restores a domain in such a case, the domain is placed in Registrar Hold Status until the registrant provides accurate and updated WHOIS information. Domain owner needs to send formal documents (e.g. ID) for validation.
In the case of illegal activity or activity not permitted according to the terms of this page and specifically 5.1.iv and 5.7, the Company has the right to suspend (Registrar Hold ή Client Hold status) a domain and proceed to its deletion regardless the validation of WHOIS information within or outside the timeframe of 10 days.

10. Security

10.1 All transactions made through the https://www.creativeoptions.eu/ are governed by the International and European laws, which regulate matters concerning electronic commerce and the Law of Consumer Protection (Law 2251/1994), which regulates all matters on distance selling. The Company recognizes the importance of the issue of security of personal data and electronic transactions and thus has taken all necessary measures with the most modern and advanced methods to ensure maximum safety. All information related to your personal information is secure and confidential.

The Company achieves the security of online shop with the following methods:

10.2 The codes used for identification are two: the Username and the Password, which are required each time you attempt to access the account. This is to provide absolute security to the personal data of Customer. A possible change of Personnel Security password (password) is offered as often as desired by the Client. The only person who has access to these codes is the Client and he is solely responsible for maintaining the privacy from third persons. The password used by the Customer will be more than 6 characters with letters, numbers and symbols. In case of loss or leakage, immediate notice should be given to the Company. The Company is not responsible for the use of the password by an unauthorized person. The online store of the Company, in any way, will not disclose the personal data and information supplied to the Company. The personal data that is provided by the Client to the Company is used exclusively for the execution of transactions. All information is encrypted and stored safely.

10.3 The Client must always have his contact details updated and notify the Company of any changes in them. The Company will contact the Customer on matters relating to the account (upgrades to servers, expiration – Renewal account, etc.) through email or through the information pages on the Company site. The Client must regularly check the email designated as the main contact email and the website of the Company, to get informed on matters related to the account. The email address should not be an email kept in the servers of our Company.

10.4 All information supplied by the Client / subscriber of the Company is confidential and the Company has taken all necessary measures in order to use them only when necessary in the context of service. Some of the measures taken are the following:

i. Authorized officials have access to trade only if it is necessary, e.g., for handling requests.

ii. The Company does not disclose the details of Clients and their transactions, unless there is a written authorization from the client or it is required by court order or it is a decision of any public authority.

Iii. If the Company uses third parties to support its systems, it ensures the guarantee of confidentiality.

iv. The Client may request any information held on this and correct them if they can demonstrate the existence of error.

v. For safety reasons, the Client should maintain all the information provided through the service as confidential and secret and not disclose to third persons.

vi. The email address of the Customer is used by Creative Options to send informative emails-newsletters about the Company and any new offers or discounts provided herein. If the Customer does not wish to receive any emails of this type, they can be deleted from the contact list by clicking on the link at the end of each informative email-newsletter.

11. Pricing and Services Termination/ Agreement

11.1 The prices of the products are in Euros and do not include VAT. The payment for services and products should be done in advance. The Company reserves the right to change prices without prior notice to Client . It is understood that the Client always pays the price specified in the relevant price for that product or service at the time of order. All payment transaction costs (such us bank transfer costs etc) are paid by the customer.

An exception to this is the price of Premium domain names of any exception (among which are the .GR domains with two characters). The price of a Premium domain name is set by the relevant registry, refers to the specific domain name and appears in domain names search results’ page of the Company. The company is not responsible for any sudden changes in the prices of premium domains, that occur due to change of the cost by the registry.

11.2 The Company has the right to provide offers and packages that have more favourable terms or prices of those that existed when the Client initially purchased services from the Company. These changes in prices and conditions do not affect existing values of the parties.

11.3 Coupons or discounts are only valid towards the initial purchase, and do not affect the renewal or recurring price. Coupon code discounts cannot be applied in combination with other discounts a customer might be eligible for.

11.4 The price paid by the Client to the Company for hosting services will not ever change after ordering. The Company reserves the right to change any time the resources and values of hospitality service shown on the site for purchase by prospective Clients.

11.5 Payments

a. For identification purposes and in order to guarantee the security of transactions, the Customer, if requested by the company,
has to provide further documentation, such as the identity, passport etc.

b. If the Customer does not provide the information requested or the transaction is not successfully identified by the Company, the Company has the right not to provide the service and not to refund the amount related to the transaction.

c. The Customer is not allowed to make virtual, fake or improper orders of services. The Customer is solely responsible of all charges, fees, taxes and other contributions arising from the purchase of Creative Options services.

11.6 Additional Terms for Dedicated Servers:

a. For Servers hosted in US Data Centers, in case the value of  the Euro against the Dollar suffers a reduction of more that 20%, in comparison with the rate of the initial order, the Company reserves the right to adjust the monthly hosting fee, This change in the monthly cost of the customers Dedicated Server will occur one month after informing the customer.  The exchange rate valid on the date of the order is shown on the first invoice of the order.

In the case above, the increase of the monthly subscription, will not exceed the percentage growth of the exchange rate of the USD against the Euro. The price the customer pays the Company fot hosting services will never change after the order. The Company reserves the right to change at any time, the resources and the hosting services prices displayed on the website, for future customers.

b. For canceling the cooperation and receiving the money-back guarantee, the request should be submited at least 30 days before the end of the month you wish to have the server turned off.  In any other case, the renewal is completed automatically and that month’s guarantee is consumed

Payment by Credit Card or Paypal

11.7 The Client has the possibility of renewing orders by credit card (Visa, MasterCard) or through Paypal. The credit card can be used after verification and certification of data and the validity. The Client is solely responsible for the proper recording of credit card data.

11.8 The web hosting services ordered by the Customer can be paid automatically if the client selects through the Control Panel of the Company to charge the credit card automatically each month (or, depending on the cycle of renewal of the domain host for assistance of every 1, 3, 6, 9, 12, 24, 36, 48 or 60 months) and give the Company the right to receive the equivalent amount at a predetermined date each month or at such regular intervals in which the department has ordered that the Client is due.

11.9 The Client can make payments via Bank (DIAS System), at the cashier’s desk, via e-banking or phone banking, at the banks that can be found here. In this case the Customer must pay any fees of banks.

11.10 Stop Service/Agreement This Agreement may be terminated by any of the parties, without cause. The Company is not obliged to refund the agreed amount for the period remaining from the days of disruption to the normal expiry of the contract if the client requests the suspension or the contract is terminated by the Company in the event of breach of the terms by the Client.

11.11 If the Customer states that he/she doesn’t want to continue the service, the Company will disable the website of the client and delete it from the servers, without further notice.

11.12 The Company reserves the right to refuse, terminate or make the services it provides to the Customer available at will, with or without notice, and will not be responsible for impact, positive or negative, as a result of the termination of a web site from a server or any other termination of service. There is a charge to restore files to a web hosting account.

11.13 If the Customer maintains one or more outstanding services to his account, then the Company has the right to suspend, stop or delete all of the domain hosting accounts, paid or not, without the obligation to provide backup to the Customer.

11.14 The Company reserves the right to cancel an account, including files and content for any reason, at any time. The Client agrees to maintain backup copies of all files and databases in which the Company agrees that the Company will have no liability for loss of data. Customer is responsible for backing up data.

11.15 The Client, if they do not want further services of the Company should declare that through the cancellation form located at https://www.creativeoptions.eu/ cancel-account-form.htm. An email confirmation of receipt of application is sent automatically to the Client after he sends the form. If the Customer does not receive the confirmation email, Creative Options will contact him/her via telephone.

11.16 In case of non-payment or early payment, it is impossible to charge the credit card of the Client . Our services are scheduled to terminate automatically after the expiry of the subscription.

11.17 If enough balance is not available on the credit card of the Customer at the time of trying to charge the amount on the card of the Client (for the service), the services of the Company are scheduled to terminate automatically after the expiry of the subscription.

12. Money Back Guarantee

12.1 The hosting of virtual servers in the Company is accompanied by a money back guarantee within 90 days from the date of subscription of hosting account. If the Client is not satisfied with the level of hosting services offered by the Company, he may request cancellation of this Agreement within 90 days from the opening of the account, or implicitly agree to the continuation of service and waive the right for repayment of the money. In case of cancellation within 90 days, the amount of assistance shall be returned to the Client. If the amount of assistance includes additional costs (purchase domain name, purchase SSL, purchase static IP, the third commission or fees from banks or credit cards, installation costs, additional services), the amount is returned to the Customer after deduction of these expenses. No refund is made after the 90th day of the subscription. This warranty is only applicable for the Shared Hosting, Cloud Hosting and Managed WordPress Hosting packages and not to all services provided by the Company, such as Domain Names, Dedicated Server, SSL sertificates, Websitebuilder, Eshops, etc.

12.2 Only new accounts are entitled to compensation. For example, if the Client had an account with the Company, annulled it, and created a new one, he/she is not entitled to compensation for the last account.

12.3 To be considered valid, the account cancellation request must be sent via the form located at http://www.Creative Options/cancel-account-form.htm.

12.4 Any breach of this condition is considered likely to lead to non-repayment of any amount to the Customer.

13. Renewal of Domains & Services

13.1 The contract is automatically renewed under the current price list for the type of service during the period of renewal unless the Client wants further cooperation with the Company and has informed the Company about it.

13.2 In case that repayment of the assistance is paid via Bank (DIAS System), at cashier’s desk, via e-banking or phone banking, the Customer must pay any fees to the banks.

13.3 In any case, the Client must verify that the Company received the notice of renewal of assistance and activated / renewed the services for which they paid. If the Company cannot determine the balance of payment data about the service (e.g., due to undelivered fax, email non-delivery of the information to the Company), then the Company shall disable the website of the Client and delete it from the servers without any responsibility for any loss or damage caused by the termination / suspension of services to the Customer.

13.4 Creative Options, as an ICANN accredited registrar for gTLDs, such as .COM, .NET, .ORG, .BIZ etc. provides registrations for these tlds directly with no mediation of the company Tucows SA. Domains with Tucows SA. as a present registrar are automatically transfered during their renewal. The transfer is completed 5 (or 10) days after the renewal order and the renewal is completed afterwards. Attention: You may receive an email directly from ICANN, in which you will be asked to confirm your personal information via a link, in order for the transfer and renewal to be completed smoothly. The nameservers of the domain cannot be changed during these 5 (or 10) days. The domain registrar can be changed again 60 days after the renewal. By renewing you also accept the transfer of the related domains, according to the limitations mentioned in this paragraph (13.4).

13.5 Renewal of expired domains. The customer is able to renew a domain in “quarantine” from his control panel. The renewal cost from “quarantine” remains the same with the renewal cost of a domain before its expiration.

To renew a domain from “redemption”, besides the renewal cost, a redemption fee is applied which differs depending on the domain extension. The customer can view the redemption fee at the pricelist page. In case the price is not visible, a “contact support” link prompts the customer to contact Support and request information about the total renewal cost from redemption, per domain.

13.6 Auto-renewal. If the customer has activated the automatic renewal by credit card, automated emails will be sent to the administrator when the system tries to charge the credit card, 33 days before the service expiration. If the system fails to charge the credit card, the customer receives a second notification to the administrator email address 30 days before the expiration. If the second attempt also fails, the customer will receive an email notification directing him to make the renewal manually.

If the domain is required to be renewed certain days before its expiration day, the dates on which email notifications are sent adjust accordingly. Standard expiration notifications sent 20 days before expiration, are also sent for domains with the auto-renewal activated, as long as renewal is permitted during that time.

14. Additional Fees

14.1 The Company is not responsible for any taxes or fees payable in any country under any legislation relating to tax transactions made by Clients via the server offered. The Client agrees that he/she has full responsibility for taxes or fees associated with the use of the server or the products or services available or transactions made.

15. Disclaimer – Ensure – Compensation

15.1 The Company made significant efforts in updating the site https://www.creativeoptions.eu/ to include accurate and updated information. However, the content published is not bound to the accuracy, completeness and temporal proximity and therefore bears no liability of any kind. In particular, the Company tests the validity of the functionality and the appearance of the Company’s website on the two most recent (2) versions of browsers: Google Chrome, Mozilla Firefox, Opera and Internet Explorer. The Company is not liable for any resulting change in the functionality or the content of the website, due to the use of older version of the above browsers, or any other browser, by the Client.

15.2 The Client agrees to defend the Company against any court and will ensure that we keep away from any danger of all claims, losses, financial claims and liabilities. The Client will be responsible to cover any money including costs and attorneys’ fees, will also cover the case of any claim or damage or injury or any other cause raises the same. The Client also agrees to cover cases by any third party against the Company or the Client because of the activities and services or other acts of the Client or content and information that went through the Company servers or by any malfunction of our servers, with or without the consent of the Client or cooperating with this person.

15.3 In addition the Customer explicitly states and is bound by this, that if the Client brought against the Company any action, claim, or other judicial or administrative claim process which results from the breach by the nature of any rights of third parties, as required, both intervene in judicial or administrative procedure and on the other hand compensates fully the Company in the case the latter is obligated to pay compensation or any other expenditure.

15.4 According to the European Committee directive, consumers and merchants can use the Online Dispute Resolution (ODR) in order to solve their differences online whether they concern domestic or cross-border transactions. ODR is directly connected with the responsible Alternative Despite Resolution bodies in every country, which handle the complaints.View the dispute resolution bodies for each european country here.

16. Electronic Τransmission of Ιnvoices/Receipts

16.1 The Client has the responsibility to inform the Company about the email addresses to which the invoices will be sent. Additionally, the Customer explicitly states that these email addresses and any other information about them is in their full, exclusive and undisputed control. Μore specifically, the invoice is sent to the email address provided by the administrator in the billing information, while the receipt is sent to the email address of the account. Third parties should not have access to these addresses unless they are authorized by the Customer. The Company has no responsibility for any third party access to the email addresses of the Client or for any damage suffered by the Client due to third party access and / or use of the email addresses.

16.2 For any change in the declared data and especially in e-mail address solely responsible is the customer, who must inform the Company about the changes. The Company has no responsibility for any failure or delay of informing the Client about an invoice due to the above reason.

16.3 The Company has no responsibility for any loss (positive or negative) suffered by  the client and / or third occur due to the Client’s failure or delay to access their e-mail.

16.4 The Client accepts that the Company makes every reasonable effort to ensure the availability of electronic transmission of invoices/receipt. In any case, the client can find and download the invoice/receipt in the “Orders history” section of their account at Creative Options, as soon as the it is available.

17. Accept Terms of Use

17.1 Terms of use on the site https://www.creativeoptions.eu/ are drawn from all the norms of Greek territory, governed by Greek law, the applicable laws in the European Union and by international treaties, and are interpreted in accordance with the rules of good faith, business ethics and social and economic interest of the right. Where the terms or provisions of these terms of use are deemed void, such revocation or cancellation will not affect the validity of other conditions. The parties will follow these principles in any effort to replace the void or cancellation provisions or conditions with others that is as close as possible to that of the invalid terms or provisions.

17.2 The subscribers of the Company must be at least 18 years of age.

17.3 Using the website https://www.creativeoptions.eu/, means that you agree to all terms listed in this website after reading the required texts prior to the use of our services and any order of products and services. In addition, the fully and unconditionally acceptance of the listed terms and conditions, is expressed, certified and responsibly reported with the use of presentation and/or by clicking on the link “I have read and agree to the Terms of Use” and any other link that may lead to ordering from us or using the website of the Company, and these actions are regarded as your signature on this text.

17.4 The Company shall provide to the client third-party software, depending on the service ordered. The license conditions governing the use of the third-party software may differ from the terms of Creative Options. The customers of the Company are bound to accept all terms and conditions related to third-party software. The offer of third-party software is not a part of the software of the Company. The Company cannot provide support or guarantees regarding the use and functionality of the third-party software.

17.5 Each electronic order is sent to the Company via the Internet, if and only the Client has previously accepted unconditionally, the terms of the agreement mentioned above. It is used just as an additional proof that the Client has full knowledge of the conditions and agrees with them.

17.6 The Customer agrees that any dispute arising from the use of this presentation will be resolved by having the laws of the Greek state and jurisdiction implemented by the Courts of Heraklion, Crete. The Company has the right to amend without notice the terms of the contract service and it is the responsibility of the Client to arrange to be informed by this website and its terms.

17.7 The terms contained in this page supersede any other agreement or negotiation between the Customer and the Company, oral, written or otherwise, including any statements from a representative of the Company.

17.8 ADDITIONAL REGISTRY REQUIREMENTS

Below you find links to the Registries of the main TLDs, that might have additional terms and conditions. With a domain registration of the below TLDs, the Customer certifies that he/she has read and agrees to the terms and conditions provided by these registries.

18. RESELLERS TERMS OF USE

In addition to these Terms and Conditions, the provisions set forth shall apply if the customer acts as reseller of Creative Options services.

18.1 The reseller acting for his Customer fully agreed to these terms and conditions of SMD Single P.C.. The reseller also agrees to act according the terms and conditions of SMD Single P.C. valid by the time a contractual relationships takes affect between the Reseller and his Customer. The reseller is obliged to include the conditions of the terms and conditions of SMD Single P.C. into the agreements between the reseller and his Customers. The responsibility of a Customer for his domain remains unaffected.

SMD Single P.C. provides a non-exclusive, non-transferable, limited license to use the Reseller API to facilitate the registration and management of Domain Names and other services on behalf of its Users.

The content that is available via the service is property of SMD Single P.C. and it is protected from intellectual rights as well as other laws of intellectual property. Further content that is found in the website can being in additional restrictions. You agree not to repeat, not to broadcast, not to distribute, not to propagate, not to sell, not to publish, not to transmit or circulate this content via your website without the explicit consent of Creative Options, not to collect personal data of customers, not to reveal personal data of customers to third person, not to make bad use of system of which we allocate to you.

You agree not to repost in your website or in any other document or in any other communication with your customers that you are approved registrar of Eurid, EETT or ICANN.

Reseller is prohibited from displaying the ICANN or ICANN-Accredited Registrar logo, or from otherwise representing itself as accredited by ICANN unless it has written permission from ICANN to do so.

18.2 Any registration agreement used by the reseller include all registration agreement provisions and notices required by the ICANN Registrar Accreditation Agreement (http://www.icann.org/en/about/agreements/registrars) and any ICANN Consensus Policies, and shall identify the sponsoring registrar or provide a means for identifying the sponsoring registrar, such as a link to the InterNIC Whois lookup service.

18.3 Reseller must identify the sponsoring registrar upon inquiry from the customer.

18.4 Reseller must ensure that the identity and contact information provided by the customer of any privacy or proxy registration service offered or made available by reseller in connection with each registration will be deposited with Registrar or held in escrow or, alternatively, display a conspicuous notice to such customers at the time an election is made to utilize such privacy or proxy service that their data is not being escrowed. Where escrow is used, the escrow agreement will provide, at a minimum, that data will be released to registrar in the event reseller breaches the reseller agreement, and such breach is harmful to consumers or the public interest. In the event that ICANN makes available a program granting recognition to resellers that escrow privacy or proxy registration data as detailed above, and reseller meets any other criteria established by ICANN in accordance with its Bylaws, reseller is permitted to apply to ICANN for such recognition.

18.5 Resellers are under the obligation to provide a link to ICANN’s webpage, as described in subsection 3.15 of ICANN’s terms. The Resellers are also obliged to publish the url: http://www.icann.org/en/registrars/registrant-rights-responsibilities-en.htm on their website regarding the Resellers’ customers rights and obligations, according to ICANN’s term 3.12.7 (Registrar Accreditation Agreement, url: https://www.icann.org/resources/pages/approved-with-specs-2013-09-17-en).

18.6 With your registration as a reseller and for and other relative services (henceforth “services”), you declare that you agree to the terms and the provisions that are included in this agreement.

The services include the following:

a) Registration of domain names that is offered by Creative Options, included the service whois

b) DNS services

c) Domain names check

d) Other services, such as web hosting, sitebuilder etc.

e) Telephone and email support

f) Commercial services for credit cards charges and other services of SMD Single P.C. that it can provide you via account and the API.

You and/or your customers can be the direct users of the services. Moreover, your customers can also be contracting parts (“your resellers”) that wish reseller services.

The reseller is obliged to have an authorised order from its Client, in order to be allowed to act in the name of its Client (for example by logfiles of an online password check ). Each order by the reseller for it’s Client must be clear and provable!

18.7

a. The reseller is obligated to inform his Customer about all concerns of his domain and to take all necessary actions on behalf of his Customer.

b. SMD Single P.C. reserves the right to contact a Customer for approval before a modification or addition of domain data.

c. The reseller is committed to include in her own Terms and Conditions, that the Reseller (acting as Supplier for her Clients/Registrants) is authorised from name of Registrant to sign for registrations, transfers, raising domain names and to modify any data concerning domain names, as also determined in General Terms and Conditions. These rules also apply for any other products or services that are provided by SMD Single P.C..

d. If the Reseller applies for domain names for which a Domicile address is required, the Reseller is supposed to provide such an address. If the Reseller can’t meet this requirement the Domicile address of SMD Single P.C. will be used (by default).

18.8 The reseller is responsible for the service, pricing and technical support of your customers, the domain registrars. Creative Options provides telephone and email support during office hours, from 09:00 to 21:00, GMT +2, with certain exceptions for important feast days.

SMD Single P.C. can, but it is not compelled, to provide the support immediately to resellers’ customers. If SMD Single P.C. receives support requests from your registrars with regard to services that are provided by your account or a account under your account, SMD Single P.C. might provide support.

If SMD Single P.C. considers that you, as a reseller, provide insufficient support to your customers (consequently, for example, a excessive number of support calls immediately by your customers), this could be considered as a violation of this agreement by your side.

You commit that, deliberately or not, you will not make bad use of the infrastructure of services. “Bad use” in the previous sentence means, any action that will degrade the service to other users.

18.9 The Reseller remains fully responsible for all financial consequences, resulting from any order, and for any other financial consequences resulting from these Terms and Conditions.

SMD Single P.C. maintains the right to suspend the service or part of this or to exclude the use or the access in this, if any of the following occasions are presented:

a. If you fail to pay any debts to SMD Single P.C.. SMD Single P.C. has the ability to interrupt the provided services to your account in the case you are unable to cover your debts, in the particular dates of agreement.
b. If you, from excessive use or bad-treatment of services or of its technology, create problem in other users of other services and SMD Single P.C.’s system.
c. If you use tools of domains availability or other technologies and tools that SMD Single P.C. offers, then you should make all your registrations through SMD Single P.C.. In any different case SMD Single P.C. maintains the rights to suspend the service to you or your resellers.
d. If you report in your website that you are accredited registrar of EURid, EETT or ICANN.

18.10 Reseller agrees to keep the economic terms of this agreement confidential.

18.11 The company has the right to terminate this agreement if the Reseller it is in breach of the section 17 of the agreement.

SMD Single P.C. in any case will not be exposed in you or your enterprise for any accidental, consequent, special, or correctional damage or lost profits or rights that result from this agreement or any services that are provided, or for the violation of the authorisation or any obligation that results from this. SMD Single P.C., in concrete cases, advertises products of third person or allows in service provider institutions to advertise their products and services in its website.

Also it contracts collaborations or alliances with various suppliers at intervals, so that is facilitated the benefit of these products and services in you. Nevertheless, you recognize and agree that SMD Single P.C. does not, in any case, bring responsibility with regard to the products or the services of any third person, neither will be responsible and exposed in you or anyone third for any claims that result from use of such products or services.

You recognize that you have read, you comprehended and agree to be committed from all the terms and the provisions of this agreement, as well as any additional rules or policies that can be established from SMD Single P.C. at intervals. This agreement, as well as any additional rules and SMD Single P.C.’s policies, containing all the additional modifications, constitute the complete and exclusive agreement between you and SMD Single P.C. with regard to the use of services, and displace and regulate all the previous proposals, agreements, or other communications.

SMD Single P.C. at his crisis, may change the terms, the provisions and the operation of this website and services at any moment. With the utilisation of this service you waive any rights or claims that you might have adversely to SMD Single P.C..

18.12 In the cases that we are obliged by the ICANN policy to send an email directly to the domain owner, Creative Options will appear as the sender of the email.

19. Terms of use for the SSL Certificates.

19.1 The SSL renewal can be made:
– 60 days before the expiration for COMODO SSL
– 90 days before the expiration for RapidSSL
– 90 days before the expiration for GeoTrust SSL

19.2 Private Key:

a. If the SSL is used for a website hosted at Creative Options’s servers, the Company creates and inserts the Private Key in the Customer’s hosting. Creative Options does not save this information in its database permanently. The private key will be available only for 24 hours since it is created and afterwards it will be deleted permanently. For security reasons, the user is recommended to download and save the private key during the ssl activation process. In case the user does not save it and it is later requested by the SSL company, then the user will have to reissue the SSL to gain the Private Key again.

b. If the SSL is used for a website that is hosted to another hosting provider, the user must download and save the private key. The user must also insert the private key to his hosting plan so that the activation of the SSL is completed. The private key is not saved in the Creative Options’s database.

19.3 The validation process that is required for the OV and EV SSL activation is handled completely by the Certificate Authority that offers each SSL. Creative Options is not responsible for the validation process or its success or failure.

19.4 Using the “freessl” coupon in the cart, every customer is eligible for one up to five free Comodo Positive SSL, for one year, per account with a new .GR domain registration. The free SSL offer is valid for old and new customers and cannot be combined with other offers or discounts at Creative Options. Τhe free Comodo Positive SSL can only be activated for Creative Options’s paid hosting plans.

20. ID Protect Terms and Conditions (Privacy Services – P&P)

20.1 General
The Id Protect service is a paid service (6.99 €/year + VAT 24%) for .COM, .NET, .ORG, .BIZ, .INFO, .NAME, .TV, .CC, .ME, .MOBI domain names. By activating the Id Protect service, the owner’s data (name, address, email) will not appear in the Whois results.

20.2 Activation
a. Id Protection can be activated using one of the following ways: choosing the service during the registration of a domain name at the 3rd step of the order. by activating the service for the domain name, in the control panel, at Creative Options.

b. The service stays active until the expiration of the domain with which the id protect service is connected and the service is charged for at least one year. It can be activated for 1 to 10 years.

c. The service is activated after the payment of the order. As soon as the order is paid (and processed by the accounting department if it is a bank payment), Creative Options informs its database and the owner’s data do not appear in the whois results. Creative Options is not responsible for how often third parties inform their own databases.

d. Before the id protection service is activated, third parties may have already collected the owner’s data. In this case, third parties can maintain the owner’s data for as long as they decide until they renew their database.

20.3 Expiration and Renewal
a. The service expires the same date as the domain name it is connected to.

b. In case the Customer has activated the auto-renewal and the id-protect with a domain name, id protect is automatically renewed with the domain name.

20.4 Deactivation
a. The administrator of the account that the order was made from can deactivate the service at any given time and for as long as he likes from the administrative environment of the service.

b. If the customer deactivates the service, the owner’s data will be visible in the whois search results for as long as the service stays deactivated. As soon as the Customer reactivates the service, the data will stop appearing again. For as long as the service was deactivated, third parties may have already collected the owner’s data . In this case, third parties can maintain the owner’s data for as long as they decide until they renew their database.

c. The deactivation of the id protect service does not affect the expiration date of the service.

20.5 Termination and disclosure of personal information
a. The company has the right to terminate the service according to the terms and conditions about the termination of service/ agreement (art. 11.10 to 11.17), resulting in owner’s data being visible in whois search results. In addition, the company may terminate the privacy service:
1. When required by law, in the good faith belief that such action is necessary in order to conform to the edicts of the law, and/or in the interest of public safety.
2. To comply with a legal process served upon the company, and/or in response to a reasonable threat of litigation against the company, as determined by the company in its sole and absolute discretion, or
3. To comply with ICANN rules, policies, or procedures.

b. You further understand and agree that if the company is investigated in anticipation of any legal or administrative proceeding arising out of your domain name registration or your use of the company’s services, the privacy service may be canceled resulting in your identity revealed on the whois directory as registrant.

c. There is no refund in case of termination of the service.

20.5 Communication
a. For any necessary communication, Creative Options contacts the administrator of the Creative Options account but not the owner of the domain name whose data is protected with Id protect.

b. In case the owner of the domain name needs to contact the company, the owner must send an email from the administrator’s email account.

20.6 Report Abuse
In order to report any illegal activity about domain names registered at Creative Options, with Id protect activated, the customer should use the form found here. Alternatively the customer cansend an email at [email protected], or call the dedicated number +30 2661022726 which is monitored 24/7. Well-founded reports of Illegal Activity are reviewed within 24 hours and appropriate actions are taken.

21 Let’s Encrypt certificate Terms and Conditions

Let’s Encrypt certificate is provided by the Company free of charge to any paid web hosting plan. It has to be activated by the Customer himself through the web hosting management interface – Plesk. The certificate remains valid as long as the web hosting package remains active in Creative Options. Its features are defined under Brand provider and the Company must follow. The Company reserves the right to repeal the free supply without other warning.

Οι παρόντες Όροι και Προϋποθέσεις εφαρμόζονται στα πωλούμενα αγαθά από την εταιρεία με την επωνυμία «SMD ΜΟΝΟΠΡΟΣΩΠΗ ΙΚΕ», τον δ.τ. «Creative Options που εδρεύει στην Κέρκυρα, Δονάτου Δημουλίτσα 34 στον 1ο όροφο, Αρ.Γ.Ε.ΜΗ. 130578133000, με Α.Φ.Μ.: 800581500 της Δ.Ο.Υ. Κέρκυρας από το ηλεκτρονικό της κατάστημα creativeoptions.eu (εφεξής “Ηλεκτρονικό Κατάστημα”).

2.Σύνδεση

Για λόγους ασφαλείας των συναλλαγών, ο Χρήστης του ηλεκτρονικού καταστήματος (εφεξής «Χρήστης» ή «Πελάτης») για την ολοκλήρωση της παραγγελίας του Χρήστη στο ηλεκτρονικό κατάστημα απαιτείται να συμπληρώσει ονοματεπώνυμο, διεύθυνση αποστολής αλληλογραφίας, τηλέφωνο επικοινωνίας και email. Οι πληροφορίες αυτές παραμένουν απολύτως εμπιστευτικές. Η ΕΤΑΙΡΕΙΑ διατηρεί το δικαίωμα να χρησιμοποιήσει τα στοιχεία αυτά για την αποστολή ενημερώσεων για νέα προϊόντα ή προσφορές, σε πελάτες της στο ηλεκτρονικό κατάστημα. Αν οποιαδήποτε χρονική στιγμή ο Χρήστης επιθυμεί να ακυρώσει την εγγραφή του στη λίστα διευθύνσεων/email, μπορεί να το κάνει αποστέλλοντας email στη διεύθυνση [email protected] προκειμένου να ζητήσει τη διαγραφή ή αλλαγή των τηρούμενων προσωπικών του στοιχείων.

3. Παραγγελία. Υποβολή και Αποδοχή

3.1. Υποβολή ηλεκτρονικής παραγγελίας

Η παραγγελία των υπηρεσιών υποβάλλεται μέσω της συμπλήρωσης και αποστολής της Φόρμας Παραγγελίας που υπάρχει στο ηλεκτρονικό κατάστημα. Πριν από την υποβολή της παραγγελίας (checkout), ο Πελάτης λαμβάνει μέσω ειδικού συνδέσμου γνώση των όρων που αφορούν την πώληση των προϊόντων ή/και υπηρεσιών που επιθυμεί να αποκτήσει και στη συνέχεια επιλέγει την ενεργοποίηση σχετικού εικονιδίου (ένδειξης) «Έχω διαβάσει και αποδέχομαι τους Όρους αγορών». Με τη σήμανση αυτή, ο Πελάτης δηλώνει ρητά και ανεπιφύλακτα ότι πριν την υποβολή της παραγγελίας του έλαβε με ευκρινή και κατανοητό τρόπο γνώση των ακόλουθων πληροφοριών:

  • i. Των κύριων χαρακτηριστικών των υπηρεσιών ή που παρήγγειλε, όπως αυτά περιγράφονται στις σελίδες του ηλεκτρονικού καταστήματος. Ο Πελάτης οφείλει να ελέγξει κάθε σχετικό χαρακτηριστικό, πριν από την υποβολή της παραγγελίας του, ούτως ώστε να μη διατηρεί καμία αμφιβολία για τα χαρακτηριστικά και τις ιδιότητες των παραγγελλομένων προϊόντων ή/και υπηρεσιών. Η ΕΤΑΙΡΕΙΑ δεν έχει καμία ευθύνη σε περίπτωση που ο Πελάτης παρέλειψε να ενημερωθεί επαρκώς για τα ανωτέρω.
  • ii. Της ταυτότητας, της διεύθυνσης, του αριθμού τηλεφώνου, του αριθμού φαξ και της διεύθυνσης ηλεκτρονικού ταχυδρομείου της ΕΤΑΙΡΕΙΑΣ.
  • iii. Της συνολικής τιμής των προϊόντων της παραγγελίας, συμπεριλαμβανομένων του Φ.Π.Α., κάθε άλλου τέλους και όλων των πρόσθετων επιβαρύνσεων αποστολής, παράδοσης ή ταχυδρομείου καθώς και κάθε άλλης δαπάνης. Όταν αυτές οι επιβαρύνσεις δεν μπορούν ευλόγως να υπολογιστούν εκ των προτέρων, το γεγονός ότι μπορεί να απαιτηθούν τέτοιες πρόσθετες επιβαρύνσεις γίνεται γνωστό στον Πελάτη στο κείμενο της παραγγελίας (φόρμα παραγγελίας) και ο Πελάτης οφείλει να λάβει γνώση πριν από την υποβολή της παραγγελίας. Πρόσθετες επιβαρύνσεις ή άλλες δαπάνες που δεν έγιναν γνωστές στον Πελάτη πριν την υποβολή της παραγγελίας του ή σε περίπτωση που δεν μπορούσαν κατά την παραγγελία να υπολογιστούν δεν γνωστοποιήθηκαν στον Πελάτη τηλεφωνικώς πριν την επιβεβαίωση παραλαβής της παραγγελίας, τότε αυτές δεν βαρύνουν τον Πελάτη χωρίς την προηγούμενη ρητή συναίνεση του. Ειδικότερα, οι αναγραφόμενες τιμές των προϊόντων όπως τίθενται στο ηλεκτρονικό κατάστημα είναι οι τελικές (συμπεριλαμβανομένου του αναλογούντος Φ.Π.Α.). Οι ως άνω αναγραφόμενες τελικές τιμές κάθε προϊόντος στο ηλεκτρονικό κατάστημα δεν συμπεριλαμβάνουν τα έξοδα αποστολής, τα οποία υπολογίζονται στη συνέχεια του κειμένου της παραγγελίας με βάση την επιλογή του τρόπου αποστολής.
  • iv. Των μέσων πληρωμής, παράδοσης, εκτέλεσης, αλλά και της προθεσμίας εντός της οποίας η ΕΤΑΙΡΕΙΑ αναλαμβάνει να παραδώσει τα αγαθά ή να παράσχει τις υπηρεσίες.
  • v. Των τυχόν περιορισμών παράδοσης και των μέσων πληρωμής.
  • vi. Των προϋποθέσεων, των εξαιρέσεων, της προθεσμίας και των διαδικασιών άσκησης του δικαιώματος υπαναχώρησης καθώς και της υποχρέωσης επιβάρυνσης του Πελάτη με το άμεσο κόστος επιστροφής των προϊόντων στην ΕΤΑΙΡΕΙΑ, σε περίπτωση υπαναχώρησης του.
  • vii. Σε περίπτωση που ο Πελάτης ασκήσει το δικαίωμα υπαναχώρησης αφού έχει κάνει χρήση της υπηρεσίας, θα πρέπει να καταβάλει εύλογο κόστος στην ΕΤΑΙΡΕΙΑ.
  • viii. Όταν δεν παρέχεται δικαίωμα υπαναχώρησης με βάση το Νόμο, την πληροφορία ότι ο Πελάτης δεν θα έχει δικαίωμα υπαναχώρησης ή, κατά περίπτωση, τις περιστάσεις υπό τις οποίες ο Πελάτης χάνει το δικαίωμα της υπαναχώρησης.
  • ix. Της ύπαρξης της ευθύνης της ΕΤΑΙΡΕΙΑΣ για πραγματικά ελαττώματα και έλλειψη συνομολογημένων ιδιοτήτων
  • x. Της διάρκειας της σύμβασης, όπου τυγχάνει εφαρμογής, ή, εάν η σύμβαση είναι αορίστου χρόνου ή της αυτόματης παράτασης, των όρων για τη λήξη της σύμβασης
  • xi. Όπου τυγχάνει εφαρμογής, της ελάχιστης διάρκειας των υποχρεώσεων του Πελάτη βάσει της σύμβασης.
  • xii. Όπου τυγχάνει εφαρμογής, της ύπαρξης και των όρων κατάθεσης χρημάτων
  • xiii. Της υποχρέωσης πληρωμής με την υποβολή της παραγγελίας.

Η αποστολή της παραγγελίας προς την ΕΤΑΙΡΕΙΑ αποτελεί πρόταση για αγορά των παραγγελλόμενων αγαθών και δήλωση αποδοχής όλων των χρεώσεων που στην παραγγελία περιγράφονται Αν δεν υπάρχει ενημέρωση ή αποδοχή, ο Πελάτης δικαιούται την επιστροφή αυτής της πληρωμής.

3.2. Επιβεβαίωση παραλαβής ηλεκτρονικής παραγγελίας – Κατάρτιση πώλησης

Η παραγγελία δεν είναι δεσμευτική για την ΕΤΑΙΡΕΙΑ, πριν ο Πελάτης λάβει την επιβεβαίωση της αποδοχής της παραγγελίας από την ΕΤΑΙΡΕΙΑ, όπως περιγράφεται κατωτέρω.

H παραγγελία θεωρείται ληφθείσα από την ΕΤΑΙΡΕΙΑ από την στιγμή που ο Πελάτης λάβει σχετική ενημέρωση της κατάστασης παραγγελίας. Οι ενημερώσεις περί της κατάστασης παραγγελίας αποστέλλονται με email στην ηλεκτρονική διεύθυνση επικοινωνίας που έχει καταχωρήσει ο Χρήστης. Η κατάσταση της παραγγελίας ενημερώνεται όπως και όταν προκύπτουν αλλαγές κατά την διαχείριση της παραγγελίας. Ο Πελάτης οφείλει να ενημερώνει την ΕΤΑΙΡΕΙΑ (το αργότερο εντός 2 ωρών από την ώρα της λήψης ηλεκτρονικής ειδοποίησης για την καταχώρηση της παραγγελίας) εγγράφως για οποιοδήποτε λάθος, άλλως τα στοιχεία που αναφέρονται στην επιβεβαίωση καταχώρησης της παραγγελίας θα εφαρμοσθούν στη Σύμβαση Πώλησης.

Κατά τη διάρκεια επεξεργασίας κάθε καταχωρηθείσας παραγγελίας επιβεβαιώνεται η διαθεσιμότητα αποθέματος των προϊόντων της παραγγελίας.

Η κατάσταση της παραγγελίας ενημερώνεται συνεχώς όπως και όταν προκύπτουν αλλαγές κατά την διαχείριση της παραγγελίας του Πελάτη.

Ο Πελάτης επίσης έχει τη δυνατότητα να ενημερώνεται για την πορεία της παραγγελίας, είτε τηλεφωνικά (τηλ: 2661022726), είτε μέσω αποστολής ηλεκτρονικού μηνύματος (e-mail στην ηλεκτρονική διεύθυνση: [email protected] )

Περιορισμοί Ευθύνης: Στο πλαίσιο της καλής πίστης και των συναλλακτικών ηθών, η ΕΤΑΙΡΕΙΑ δεν υποχρεούται να αποδεχθεί παραγγελία και να συνάψει πώληση προϊόντων, που λόγω τυπογραφικού ή μηχανογραφικού λάθους, εμφανίζονται στο ηλεκτρονικό κατάστημα με τιμή εσφαλμένη, ήτοι μικρότερη ή μεγαλύτερη από την ισχύουσα για το εν λόγω χρονικό διάστημα. Σε περίπτωση που σε παραγγελία τέτοιο σφάλμα στην τιμή διαπιστώνεται σε μέρος μόνο των παραγγελθέντων προιόντων, τότε η παραγγελία ισχύει και εκτελείται κανονικά για τα υπόλοιπα προϊόντα και θεωρείται μη ολοκληρωθείσα για τα προϊόντα στα οποία διαπιστώθηκε το σφάλμα, εκτός από την περίπτωση που τα είδη στην παραγγελία είναι συναφή, πρόκειται να χρησιμοποιηθούν ως ενιαίο σύνολο και λειτουργούν ως μονάδα το ένα με το άλλο και ο Πελάτης δηλώσει ότι η μερική εκπλήρωση της παραγγελίας δεν εξυπηρετεί τις ανάγκες ή τα συμφέροντά του, οπότε η ΕΤΑΙΡΕΙΑ οφείλει να ακυρώσει ολόκληρη την παραγγελία.

Σε περίπτωση εσφαλμένης αποστολής μη παραγγελθέντων προϊόντων, η ανεπιφύλακτη παραλαβή τους ή η παράλειψη ενημέρωσης της ΕΤΑΙΡΕΙΑΣ και επιστροφής των προϊόντων δεν δύναται να θεωρηθεί ως συναίνεση, αποδοχή ή δήλωση βούλησης για αγορά τους. Σε περίπτωση που ζητηθεί επιστροφή εκ μέρους της ΕΤΑΙΡΕΙΑΣ και ο Πελάτης καθυστερεί να επιστρέψει τα προϊόντα αυτά για διάστημα μεγαλύτερο των επτά (7) ημερολογιακών ημερών τότε η άρνησή του αυτή συνιστά δήλωση βούλησης αγοράς των ειδών και η παραγγελία θεωρείται ότι έχει επιβεβαιωθεί και ο Πελάτης οφείλει να καταβάλει την αξία τους.

4. Διαθεσιμότητα προϊόντων

Ο Πελάτης ενημερώνεται για την διαθεσιμότητα των προϊόντων μέσω ενδείξεων που τίθενται στη σελίδα κάθε προϊόντος στο ηλεκτρονικό κατάστημα. Η ΕΤΑΙΡΕΙΑ επιφυλάσσεται για την διαθεσιμότητα των προϊόντων της εάν αυτά δεν είναι διαθέσιμα κατά τον χρόνο της παραγγελίας. Στην περίπτωση αυτή, η ΕΤΑΙΡΕΙΑ επιφυλάσσεται να μην αποδεχτεί τη συγκεκριμένη παραγγελία και ως εκ τούτου να μην καταρτιστεί η πώληση. Τυχόν πληρωμές θα επιστρέφονται στον Πελάτη χωρίς αδικαιολόγητη καθυστέρηση, με τον ίδιο τρόπο που ο Πελάτης επέλεξε να πληρώσει την παραγγελία του.

Η ΕΤΑΙΡΕΙΑ γνωστοποιεί κάθε φορά στον Πελάτη τον εκτιμώμενο χρόνο παράδοσης του παραγγελλόμενου προϊόντος, αναλόγως των περιστάσεων. Σε κάθε περίπτωση η ΕΤΑΙΡΕΙΑ δεσμεύεται να παραδώσει το παραγγελθέν προϊόν εντός τριάντα (30) ημερών από την επιβεβαίωση παραλαβής της παραγγελίας. Ωστόσο, η ΕΤΑΙΡΕΙΑ επιφυλάσσεται να ενημερώσει τον Πελάτη σε περίπτωση συνδρομής επιγενόμενων λόγων που καθιστούν το προϊόν μη διαθέσιμο ή για τον πιθανό (νέο) χρόνο παράδοσης εφόσον συντρέχουν λόγοι καθυστέρησης της παράδοσης. Στην περίπτωση αυτή, εφόσον κρίνεται ότι η καθυστέρηση καθιστά τη συναλλαγή ασύμφορη για τον Πελάτη, ο Πελάτης δικαιούται να προβεί μονομερώς σε ακύρωση της παραγγελίας με έγγραφη δήλωσή του (με ηλεκτρονικό μήνυμα στο [email protected]). Εφόσον ακυρωθεί η παραγγελία και έτσι καταγγελθεί η σύμβαση πώλησης, η ΕΤΑΙΡΕΙΑ οφείλει να επιστρέψει, χωρίς αδικαιολόγητη καθυστέρηση, όλα τα χρήματα που της είχε καταβάλλει ο Πελάτης.

Μη διαθεσιμότητα μέρους παραγγελίας: Αν η έλλειψη διαθεσιμότητας αφορά μέρος μόνον των παραγγελθέντων προϊόντων της παραγγελίας, το υπόλοιπο της παραγγελίας εκτελείται κανονικά, εκτός και εάν τα προϊόντα της παραγγελίας είναι συναφή, και πρόκειται να χρησιμοποιηθούν ως ενιαίο σύνολο και ο Πελάτης δηλώσει ότι η μερική εκτέλεση της παραγγελίας δεν εξυπηρετεί τις ανάγκες ή τα συμφέροντά του, οπότε η ΕΤΑΙΡΕΙΑ οφείλει να ακυρώσει ολόκληρη την παραγγελία.

5. Παράδοση παραγγελίας

5.1. Τόπος Παράδοσης

Παραλαβή από φυσικό κατάστημα δωρεάν: Στην περίπτωση που ο Πελάτης επιλέξει κατά την υποβολή της παραγγελίας του, παραλαβή από το φυσικό κατάστημα της Creative Options, θα λάβει ηλεκτρονική ενημέρωση για τον εκτιμώμενο χρόνο παραλαβής της παραγγελίας του από το εν λόγω κατάστημα (επιβεβαίωση παραλαβής). Ο Πελάτης υποχρεούται να παραλάβει την παραγγελία του εντός πέντε ημερολογιακών ημερών την παραλαβή της σχετικής ειδοποίησης παραλαβής. Εφόσον ο Πελάτης δεν παραλάβει το προϊόν εντός πέντε (5) ημερολογιακών ημερών από τη λήψη της ειδοποίησης προς παραλαβή, η ΕΤΑΙΡΕΙΑ επιφυλάσσεται του δικαιώματος να υπαναχωρήσει από την πώληση.

Παράδοση στον τόπο που ορίζει ο Πελάτης: Στην περίπτωση που το προϊόν αποστέλλεται στον τόπο που έχει επιλέξει ο Πελάτης, το προϊόν παραδίδεται σε εξωτερικό συνεργάτη – μεταφορέα και ο Πελάτης ενημερώνεται ηλεκτρονικά, ότι το προϊόν είναι έτοιμο προς αποστολή. Τα έξοδα αποστολής υπολογίζονται βάσει της παραγγελίας του Πελάτη. Τυχόν λανθασμένη καταχώριση εκ μέρους του Πελάτη και ως εκ τούτου λανθασμένος υπολογισμός εξόδων αποστολής δεν βαρύνει την ΕΤΑΙΡΕΙΑ, αλλά τον Πελάτη. Εφόσον ο Πελάτης δεν παραλάβει το προϊόν μετά από τη λήψη της ειδοποίησης προς αποστολή και παρά τη σχετική ειδοποίηση από τον μεταφορέα, η ΕΤΑΙΡΕΙΑ επιφυλάσσεται του δικαιώματος να υπαναχωρήσει από την πώληση.

Κόστος μεταφορικών:

  • Δωρεάν για παραγγελίες αξίας άνω των 200€ και έως 10 κιλά
  • Σε κάθε άλλη περίπτωση το κόστος αποστολής διαμορφώνεται στα 4.77€ έως και 3 κιλά με επιπλέον επιβάρυνση 1,30€ για κάθε επιπλέον κιλό

5.2. Χρόνος Παράδοσης

Ο χρόνος παράδοσης των πωλουμένων προϊόντων και υπηρεσιών προσδιορίζεται στην παραγγελία αναλόγως της διαθεσιμότητας, επιβεβαιώνεται στην αποδοχή της παραγγελίας εκ μέρους της ΕΤΑΙΡΕΙΑΣ, και είναι το πολύ τριάντα (30) ημέρες από το χρόνο της κατάρτισης της πώλησης, εκτός αν υπάρξει ειδική διαφορετική συμφωνία των μερών που επιβεβαιώνεται εγγράφως, με ηλεκτρονική αλληλογραφία.

Ανωτέρα βία: Η ΕΤΑΙΡΕΙΑ δεν ευθύνεται για καθυστερήσεις στην εκτέλεση της παραγγελίας (συμπεριλαμβανομένης της παράδοσης) που οφείλονται σε περιπτώσεις που δεν μπορούν να αποδοθούν σε υπαιτιότητα της ΕΤΑΙΡΕΙΑΣ ή οφείλονται σε ανωτέρα βία και ως εκ τούτου η ΕΤΑΙΡΕΙΑ δικαιούται παράταση του χρόνου για την εκτέλεση. Ενδεικτικά παραδείγματα μπορεί να είναι απεργίες, τρομοκρατικές ενέργειες, πόλεμος, προβλήματα των προμηθευτών / μεταφοράς / παραγωγής, διακυμάνσεις των συναλλαγματικών ισοτιμιών, κυβερνητικές ή νομοθετικές πράξεις και φυσικές καταστροφές. Εάν τέτοια περιστατικά διαρκέσουν πλέον των δυο (2) μηνών, η σύμβαση πώλησης μπορεί να καταγγελθεί από οποιονδήποτε συμβαλλόμενο χωρίς αποζημίωση. Εάν ο Πελάτης κρίνει ότι δεν έχει πλέον συμφέρον από την εκτέλεση της παραγγελίας, δικαιούται να καταγγείλει τη σύμβαση πώλησης και η ΕΤΑΙΡΕΙΑ υποχρεούται να του επιστρέψει το τίμημα καθώς και κάθε άλλο ποσό που είχε πληρωθεί στο πλαίσιο της σύμβασης πώλησης.

Τυχόν παραδοθέντα προϊόντα παραμένουν στην κυριότητα της ΕΤΑΙΡΕΙΑΣ μέχρι την οριστική, πλήρη και ολοσχερή καταβολή του τιμήματος σε αυτήν.

7. Δικαίωμα υπαναχώρησης από τις εξ αποστάσεως συμβάσεις βάσει του Ν. 2251/1994 (όπως τροποποιήθηκε από την Κ.Υ.Α. Ζ1-891/2013) – Επιστροφή προϊόντων

Ο Πελάτης μπορεί να επιστρέψει εύκολα τα προϊόντα που έχει αγοράσει από το ηλεκτρονικό κατάστημα επειδή απλά άλλαξε γνώμη, εντός δεκατεσσάρων (14) ημερών από την παραλαβή τους. Ο Πελάτης μπορεί να παραδώσει τα προϊόντα απευθείας στο φυσικό κατάστημα της Creative Options ή να τα αποστείλει με δικά του έξοδα στο κατάστημα. Σε οποιαδήποτε περίπτωση για online παραγγελίες ο Πελάτης μπορεί πριν από την επιστροφή των προϊόντων να επικοινωνεί μέσω τηλεφώνου (τηλ: 26610 22726), είτε μέσω αποστολής ηλεκτρονικού μηνύματος (e-mail στην ηλεκτρονική διεύθυνση: info@creativeoptions.eu). Ειδικότερα, ο Πελάτης έχει το ανωτέρω δικαίωμα να επιστρέψει προϊόν που έχει αγοράσει από το ηλεκτρονικό κατάστημα χωρίς να αναφέρει τους λόγους, υπό τους παρακάτω όρους και προϋποθέσεις:

  • (α) Εντός προθεσμίας δεκατεσσάρων (14) ημερολογιακών ημερών από την παράδοση (όταν πρόκειται για προϊόντα) ή την παραλαβή του (όταν ο Πελάτης έχει επιλέξει «παραλαβή από το κατάστημα») και σε περίπτωση πολλών αγαθών παραγγελθέντων από τον Πελάτη με μια παραγγελία και παραδιδόμενων χωριστά από τον χρόνο παραλαβής και του τελευταίου, ο Πελάτης δικαιούται να υπαναχωρήσει από την πώλ ηση (εφεξής«Υπαναχώρηση»).
  • (β) Η υπαναχώρηση αυτή είναι αναιτιολόγητη και ο Πελάτης οφείλει να επιστρέψει το προϊόν ακριβώς στην άριστη κατάσταση που το παρέλαβε. Ειδικότερα, το επιστρεφόμενο προϊόν θα πρέπει να μην έχει χρησιμοποιηθεί, να βρίσκεται σε άριστη κατάσταση («as new»), όπως ακριβώς πριν την πώληση του, στην πλήρη αρχική του συσκευασία (κουτί, νάιλον, αφρολέξ κ.τ.λ.) τα οποία δεν θα πρέπει να έχουν σκισίματα ή φθορές/αλλοιώσεις) και με όλα τα περιεχόμενα τις αρχικής συσκευασίας (έντυπα οδηγιών χρήσεως, χαρακτηριστικών και εγγυήσεων, καλώδια συνδέσεων, software εγκατάστασης κ.τ.λ.). Επιπλέον, για να γίνει δεκτή επιστροφή του προϊόντος θα πρέπει να επιδεικνύεται το πρωτότυπο παραστατικό αγοράς (απόδειξη λιανικής, τιμολόγιο) από το πρόσωπο που αρχικά αγόρασε το προϊόν και του οποίου τα στοιχεία αποτυπώνονται στο παραστατικό αγοράς.
  • (γ) Η επιστροφή του είδους γίνεται δεκτή, μόνον εφόσον προηγουμένως ο Πελάτης έχει εξοφλήσει κάθε ποσό που επιβαρύνθηκε η ΕΤΑΙΡΕΙΑ για την αποστολή του προϊόντος σε αυτόν και τα έξοδα αποστολής για την επιστροφή του.
  • (δ) Η δήλωση υπαναχώρησης ασκείται εγγράφως με τη συμπλήρωση της σχετικής φόρμας και αποστολή της στην ηλεκτρονική διεύθυνση info@creativeoptions.eu και η ΕΤΑΙΡΕΙΑ είναι υποχρεωμένη να επιβεβαιώσει εγγράφως την παραλαβή της δήλωσης υπαναχώρησης μόλις την παραλάβει.
  • (ε) Ο Πελάτης υποχρεούται να επιστρέψει τα προϊόντα εντός δεκατεσσάρων (14) ημερολογιακών ημερών από την ημέρα κατά την οποία κοινοποίησε την υπαναχώρηση σε οποιοδήποτε φυσικό κατάστημα Creative Options.
  • (στ) Κατόπιν της δήλωσης υπαναχώρησης, η ΕΤΑΙΡΕΙΑ υποχρεούται να αποδώσει στον Πελάτη το τίμημα που εισέπραξε. Στην περίπτωση χρέωσης του Πελάτη μέσω πιστωτικής κάρτας, η ΕΤΑΙΡΕΙΑ, εφόσον έχει εισπράξει το τίμημα από την Τράπεζα, θα υποχρεούται να ενημερώσει την Τράπεζα για την ακύρωση της συναλλαγής και η Τράπεζα θα προβεί σε κάθε προβλεπόμενη ενέργεια. Η ΕΤΑΙΡΕΙΑ κατόπιν της ενημέρωσης αυτής ουδεμία ευθύνη φέρει για το χρόνο και τον τρόπο εκτέλεσης του αντιλογισμού, που ρυθμίζεται από τη σύμβαση που έχει καταρτιστεί μεταξύ της εκδότριας τράπεζας και του Πελάτη. Στην περίπτωση που ο Πελάτης είχε επιλέξει την δυνατότητα «παραλαβή από το κατάστημα», η επιστροφή των χρημάτων σε αυτόν θα γίνεται από το κατάστημα της ΕΤΑΙΡΕΙΑΣ. Η επιστροφή του τιμήματος λόγω υπαναχώρησης στον Πελάτη θα γίνεται το αργότερο εντός δεκατεσσάρων (14) εργασίμων ημερών από την χρόνο που η ΕΤΑΙΡΕΙΑ έλαβε αποδεδειγμένα γνώση για την υπαναχώρησή του.
  • (ζ) Δεν επιστρέφονται δαπάνες παράδοσης μόνον εάν ο Πελάτης είχε επιλέξει τρόπο παράδοσης άλλον από τον φθηνότερο τυποποιημένο τρόπο παράδοσης που προσφέρει η ΕΤΑΙΡΕΙΑ.
  • (η) Ο Πελάτης ευθύνεται να αποζημιώσει την ΕΤΑΙΡΕΙΑ, εάν έκανε χρήση άλλη από εκείνη που είναι αναγκαία για τη διαπίστωση της φύσης, των χαρακτηριστικών και της λειτουργίας των αγαθών στο διάστημα μέχρι τη δήλωση της υπαναχώρησης, η δε ΕΤΑΙΡΕΙΑ δικαιούται να συμφωνήσει με τον Πελάτη την αποζημίωσή της ακόμα και με αμοιβαίο συμψηφισμό. Σε περίπτωση που η υπαναχώρηση αφορά παροχή υπηρεσιών, ο Πελάτης οφείλει να καταβάλει ένα ποσό ανάλογο προς τα παρασχεθέντα μέχρι τη δήλωση υπαναχώρησης. Εάν ο Πελάτης ασκήσει το δικαίωμα της υπαναχώρησης τυχόν συνδεδεμένες συμβάσεις λήγουν αυτομάτως, χωρίς κανένα κόστος για τον Πελάτη.
  • (ι) Προϊόν το οποίο είχε πωληθεί με επιπλέον δώρο θα πρέπει να επιστραφεί μαζί με το επιπλέον δώρο, διαφορετικά η αξία του δώρου θα αφαιρεθεί από το επιστρεφόμενο ποσό.

8. Εξαιρέσεις από το Δικαίωμα Υπαναχώρησης της παρ. 7

Το δικαίωμα υπαναχώρησης εκ του άρθρου 4 § 10 ν. 2251/1994 δεν εφαρμόζεται:

  • Στις περιπτώσεις που το τίμημα των προϊόντων έχει καταβληθεί στο φυσικό κατάστημα και επιπλέον, τα προϊόντα έχουν παραληφθεί από το φυσικό κατάστημα, καθώς η πώληση δεν θεωρείται ότι τελέστηκε από απόσταση.
  • Προϊόντα τα οποία δεν είναι κατάλληλα προς επιστροφή, για λόγους προστασίας της υγείας ή για λόγους υγιεινής, και τα οποία έχουν αποσφραγιστεί μετά την παράδοση.
  • Προϊόντα που έχουν χρησιμοποιηθεί

9. Αξιώσεις λόγω ελαττωματικότητας ή έλλειψης συνομολογημένης ιδιότητας

Η Υπαναχώρηση δεν αφορά ελαττωματικά προϊόντα ή προϊόντα στα οποία υπάρχει έλλειψη συνομολογημένης ιδιότητας, τα οποία καλύπτονται από τις αντίστοιχες εγγυήσεις τους.

9.1. Ευθύνη Πωλητή για πραγματικά ελαττώματα ή έλλειψη συνομολογημένων ιδιοτήτων

Σε περίπτωση ευθύνης της ΕΤΑΙΡΕΙΑΣ για πραγματικό ελάττωμα ή για έλλειψη συνομολογημένης ιδιότητας του προϊόντος («νόμιμη εγγύηση»), ο Πελάτης δικαιούται κατ’ επιλογήν του: α) να απαιτήσει, χωρίς επιβάρυνσή του, τη διόρθωση ή αντικατάσταση του προϊόντος με άλλο, εκτός αν μία τέτοια ενέργεια είναι αδύνατη ή απαιτεί δυσανάλογες δαπάνες, β) να ζητήσει μείωση του τιμήματος ή γ) να υπαναχωρήσει από τη σύμβαση πώλησης, εκτός αν πρόκειται για επουσιώδες πραγματικό ελάττωμα. Για να θεωρείται μία ιδιότητα συνομολογημένη, θα πρέπει να έχει συμφωνηθεί εγγράφως. Εάν ο Πελάτης επιλέξει τη διόρθωση ή την αντικατάσταση του προϊόντος η ΕΤΑΙΡΕΙΑ οφείλει να προβεί σε διόρθωση ή αντικατάσταση σε εύλογο χρόνο.

Σε κάθε περίπτωση που ο Πελάτης διαπιστώσει κάποιο ελάττωμα έχει τη δυνατότητα να επικοινωνήσει με το ηλεκτρονικό κατάστημα αμέσως μετά την παράδοση την ίδια ημέρα ή την επόμενη εργάσιμη στο 2661022726 ή στο email info@creativeoptions.eu. Εφόσον ένα προϊόν δηλωθεί ως ελαττωματικό από τον Πελάτη, η ΕΤΑΙΡΕΙΑ επιφυλάσσεται ρητώς για την πρότερη διάγνωση του προϊόντος ως ελαττωματικού από αρμόδιους τεχνικούς.

10. Tελικές διατάξεις
10.1 Η Creative Optionsσε καμία περίπτωση δεν φέρει ευθύνη για τυχόν απαιτήσεις νομικής ή αστικής ή και ποινικής φύσεως ούτε για τυχόν ζημία από επισκέπτες του διαδικτυακού μας τόπου ή τρίτους από αιτία που έχει σχέση με τη λειτουργία ή μη ή και τη χρήση του διαδικτυακού ή και σε εύλογη αδυναμία παροχής υπηρεσιών και προϊόντων που διατίθενται από αυτόν ή και από τυχόν μη επιτρεπόμενες παρεμβάσεις τρίτων σε προϊόντα ή και υπηρεσίες ή και πληροφορίες που διατίθενται μέσω αυτού. Ωστόσο, προς διασφάλιση των συναλλαγών διαθέτει σύστημα Secure Shell Layer (SSL). Δεν ευθύνεται για παράνομη χρήση πιστωτικής κάρτας από μή κάτοχο, εφόσον, δεν έχει δηλωθεί στην τράπεζα η απώλειά της καθώς συνιστά ευθύνη του Πελάτη η φύλαξη της πιστωτικής του κάρτας.

10.2 Η Creative Options εκδίδει αποδείξεις λιανικής πώλησης ή τιμολόγιο. Στην περίπτωση έκδοσης τιμολογίου είναι απαραίτητα τα εξής στοιχεία: Επωνυμία, Α.Φ.Μ., Δ.Ο.Υ, Επάγγελμα, Διεύθυνση, Τηλέφωνο.

10.3 Οι παρών όροι μπορεί να τροποποιηθούν χωρίς προηγούμενη ενημέρωση.
